Smurfit-Stone Container Corporation Retirement Plans

In January of 2010 we brought a class action lawsuit against certain members of Smurfit-Stone Container Corporation’s Board of Directors and administrators of the Smurfit-Stone Container Corporation Savings Plan, the Jefferson Smurfit Corporation Hourly Savings Plan, the Smurfit-Stone Container Corporation Hourly Savings Plan, and the St. Laurent Paperboard Hourly Savings Plan (collectively, the “Savings Plans), as well as the Smurfit-Stone Container Corporation Pension Plan for Salaried Employees and the Smurfit-Stone Container Corporation Pension Plan for Hourly Employees (collectively, the “Pension Plans”) on behalf of participants in and beneficiaries of the Plans. The complaint alleges that defendants – plan fiduciaries – breached the obligations to the Plans and their participants by continuing to invest class members’ retirement assets in Smurfit-Stone stock. In particular, the complaint focuses on defendants’ failure to protect the investments of class members in spite of their knowledge of Smurfit-Stone’s serious mismanagement and improper business practices that resulted in Smurfit-Stone’s bankruptcy filing in January 2009.
